I. Definitions – the terms used in these Terms and Conditions shall have the following meanings:

  1. Online Shop (Shop) – the website available at www.marpur.pl through which the Customer may browse the product range and place orders;
  2. Customer – a natural person, a legal person or an organisational unit that is not a legal person but is granted legal capacity under specific provisions, who places an Order via the Shop;
  3. Consumer – in accordance with Article 22[1] of the Civil Code, this means a natural person who enters into a legal transaction with a trader that is not directly related to their business or professional activity.
  4. Civil Code – the Act of 23 April 1964 (Journal of Laws No. 16, item 93, as amended);
  5. Terms and Conditions – these Terms and Conditions for the provision of electronic services via the online shop www.MARPUR.pl
  6. Goods – products presented in the Online Shop;
  7. Sales Contract – a contract for the sale of Goods within the meaning of the Civil Code, concluded between the online shop www.MARPUR.pl and the customer, entered into via the Shop’s website;
  8. The Consumer Rights Act – the Act of 30 May 2014 on consumer rights (Journal of Laws of 2014, item 827);
  9. The Act on the Provision of Electronic Services – the Act of 18 July 2002 on the Provision of Electronic Services (Journal of Laws No. 144, item 1204, as amended);
  10. Order – a declaration of intent by the Customer, aimed directly at concluding a Contract of Sale, specifying in particular the type and quantity of the Goods.


II. General Provisions

  1. These Terms and Conditions set out the rules for using the online shop available at: www.marpur.pl
  2. These Terms and Conditions constitute the terms and conditions referred to in Article 8 of the Act on the Provision of Electronic Services.
  3. The online shop operating at www.marpur.pl is run by MAR-PUR Mariusz Kaczmarek, Świba 159, 63-600 Kępno, NIP 9970044089, REGON 300481674
  4. These Terms and Conditions set out, in particular:
    1. the rules for registering and using an account on the online shop;
    2. the terms and conditions for making online bookings and purchasing products available via the online shop;
    3. the terms and conditions for placing Orders electronically via the online shop;
    4. the rules for concluding sales contracts using the services provided via the online shop.
  5. In order to conclude a sales contract and use the Shop, it is necessary to have devices enabling access to the Internet, email and a web browser capable of displaying web pages.
  6. The costs incurred by the Customer in using the Internet depend on the price list of the telecommunications operator or Internet service provider used by the Customer and are borne by the Customer personally.
  7. The Customer may contact the shop at www.marpur.pl via email: biuro@marpur.pl by telephone on 607 462 647 on working days, from Monday to Friday, during the hours specified on the website, and in writing by post to the address: MAR-PUR Mariusz Kaczmarek, Świba 159, 63-600 Kępno


III. Order placement and fulfilment procedure

  1. To use the Online Shop and place an Order, please use the order form, which becomes available once you have added products to your shopping basket.
  2. Information about the Goods provided on the Shop’s website, in particular their descriptions, technical and functional specifications, and prices, constitutes an invitation to conclude a contract within the meaning of Article 71 of the Civil Code.
  3. Orders are placed using the order form, providing detailed information regarding payment and delivery of the Goods.
  4. In order to submit an Order, you must accept the Terms and Conditions, provide the personal data marked as mandatory, and click the ‘Place Order with Obligation to Pay’ button.
  5. Once the Order has been placed, the Customer receives an email containing final confirmation of all the essential elements of the order.
  6. The contract is deemed to have been concluded upon the Customer’s receipt of the email referred to above.
  7. The sales contract is concluded in Polish, with its content in accordance with the Terms and Conditions.
  8. The basic condition for the fulfilment of purchases is the correct provision of contact details, including a valid email address and a telephone number at which the order can be confirmed.
  9. Orders can be placed 24 hours a day, all year round. Orders placed on weekdays after 12:00, on Saturdays, Sundays and public holidays will be processed on the next working day.
  10. In the event of errors in the product description, pricing errors or technical faults on the online shop, the Seller may cancel an incorrect order, having first notified the Buyer.
  11. Should circumstances arise that prevent the fulfilment of an order, either completely or temporarily, the MARPUR online shop undertakes to notify the Customer immediately.
  12. When ordering a custom-made mattress, with non-standard dimensions or specifications, we require advance payment of the order by bank transfer to the following business account: Mariusz Kaczmarek, PLN account number: 85 1090 1144 0000 0001 4971 2365
  13. The MARPUR online shop issues a receipt or VAT invoice for the goods purchased. To receive a VAT invoice, please provide your company details correctly, including your tax registration number (NIP).


IV. Delivery

  1. Information on delivery costs is provided in the shopping basket under the ‘Delivery’ section and in the email confirming the Customer’s Order. Delivery costs are added to the price of the Goods and are borne by the Customer.
  2. The delivery charge is shown as a separate item on the sales document. In cases where delivery is free of charge for the Customer, the charge is paid by the MARPUR online shop. The delivery charge does not appear as an item on the sales document.
  3. Orders for mattresses are processed within 1–5 working days; for beds and other products, within approximately 2–3 weeks.
  4. The order processing time is the period from when the payment is credited to the account until the parcel is handed over to the courier.
  5. If it is not possible to fulfil the order within the timeframe specified in point 3 above, the Customer will be informed of this.
  6. If delivery cannot be made using the delivery method chosen by the Customer, they will be informed of this by telephone or email.
  7. The driver is not obliged to carry mattresses and furniture into the flat. Delivery is to the front door. You must arrange for people to help carry the furniture inside on the day of delivery.


V. Prices and payment methods

  1. The prices of goods available in the MARPUR online shop are quoted in Polish zlotys and euros and include VAT (gross prices).
  2. Customers may pay for their purchases:
    1. by bank transfer
    2. in cash on collection
    3. via the ‘Przelewy24’ instant online payment service, including payment by debit or credit card and BLIK
    4. by instalment plan


VI. Right to withdraw from the contract

  1. Every customer has the right to withdraw from the contract without giving any reason, by submitting a statement to that effect within 14 (in words: fourteen) days from the date of receipt of the goods (i.e. from the date on which the Consumer or a third party designated by them, other than the carrier, takes possession of the goods). To meet this deadline, it is sufficient to send the notice before the deadline expires.
  2. When withdrawing from the contract for the sale of the Goods, the Consumer may use one of the model statements provided below, although this is not mandatory: Download the Goods Return Form
  3. In the event of withdrawal from the contract, the Consumer is obliged to return the Goods without delay to the following address: MAR-PUR Mariusz Kaczmarek, Świba 159, 63-600 Kępno, but no later than 14 days from the date on which they withdrew from the contract.
  4. The MARPUR Online Shop will refund the payment received within 14 days of receiving the notice of withdrawal from the contract, but may withhold the refund until the Goods have been received.
  5. The returned item must not be damaged or soiled. It may only be used to the extent necessary to ascertain the function and usability of the purchased item. In the event of damage to the returned product, the seller may deduct the cost of the damage caused to the item. Proof of purchase (receipt or invoice) must be included with the parcel containing the returned product; the product should ideally be packed in its original packaging.
  6. The costs of returning the purchased items are borne by the buyer.


VII. Protection of personal data

  2. The Data Controller will process customers’ personal data provided in the order form or in the user account registration form.
  3. Personal data is processed in accordance with the provisions of Regulation (EU) (EU) of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 (hereinafter “GDPR”)
  4. In the case of product orders, personal data is processed for the purpose of fulfilling the order and performing the contract for the sale of products until the order has been completed. Furthermore, once the sale has been completed, in the Controller’s legitimate interest, the Customer’s data is retained to protect the Controller against any potential claims and to demonstrate compliance with legal provisions for a period not shorter than the expiry of the limitation periods. Once every three years, the Controller will review whether the processing of personal data is still necessary. Any unnecessary data will be deleted immediately.
  5. In accordance with applicable law, personal data may be transferred to entities processing it on behalf of the Controller, e.g. subcontractors providing our services, transport and courier companies, and entities authorised to obtain data under applicable law, e.g. courts or law enforcement agencies – where they make a request based on a valid legal basis.
  6. You have the right to request access to your personal data, to have it rectified, erased or its processing restricted. You may also withdraw your consent to the processing of personal data, lodge an objection, submit a complaint to the supervisory authority, and exercise other rights set out in detail in the GDPR. The right to withdraw consent may be exercised at any time without affecting the lawfulness of processing carried out on the basis of consent prior to its withdrawal.


VIII. Complaints regarding goods

  1. The MARPUR online shop, as the seller, is liable to the Customer who is a consumer within the meaning of Article 22[1] of the Civil Code, under the warranty for defects to the extent specified in the Civil Code, in particular in Article 556 and Articles 556[1]–556[3] et seq. of the Civil Code.
  2. Notwithstanding the above, the Goods offered in the online shop are covered by a two-year Guarantee.
  3. Change in foam colour. We manufacture our mattresses on an ongoing basis, using new, unused materials (foam, springs, latex, etc.). When exposed to oxygen, new foam changes colour to a more yellowish hue, which is a natural phenomenon occurring in every mattress. Colour changes after a few weeks, such as the foam turning yellow, are therefore not covered by the guarantee.
    Indentations on the mattress surface. A mattress is an item made from soft and elastic materials that are constantly in use and are therefore subject to natural wear and tear. Every new mattress becomes softer after a short period of use (2–4 months), and natural indentations also form in the foam where the body lies and where there is increased pressure. Therefore, indentations on the mattress surface of up to 3–4 cm are not covered by the warranty, as they constitute natural wear and tear of the materials which do not affect the quality or usability of the product. Only if a depression of 5 cm develops on a used mattress is this situation eligible for a complaint. Crumbling or sagging of the foam is also eligible for a complaint.
    Please remember that, when using the mattress correctly, you should flip it over every 2–3 months, turning it upside down, and rotate it from head to foot. This will allow the compressed foam to recover, and the mattress as a whole will have a longer lifespan.
    The dimensions of the mattress may vary slightly due to the elasticity of the materials (+- 5 cm).
  4. To submit a valid complaint, please send a letter or email to biuro@marpur.pl, including a description of the damage, photographs of the damage and the buyer’s details. Once the damage has been assessed, we may inform you that the product in question needs to be returned for inspection to the following address: MARPUR, Mariusz Kaczmarek, Świba 159, 63-600 Kępno, tel: 607 462 647
  5. Please enclose the completed Complaints Form, together with a description of the damage, with the product you are sending: DOWNLOAD THE COMPLAINTS FORM
  6. The product must be properly prepared for dispatch and packed, preferably in its original packaging or protective film.
  7. The cost of sending the product for a complaint, arranging a courier and the postage costs are the responsibility of the buyer.
  8. Once we have received and inspected the product, we will respond to the complaint; if the complaint is upheld, the cost of returning the product will be refunded and the product will be repaired or replaced with a new one.
  9. The online shop undertakes to process every complaint within 14 days. Failure to process a complaint within this period shall be deemed to constitute acceptance of the complaint as valid.


IX. Final Provisions

  1. In matters not covered by these Terms and Conditions, the provisions of the Civil Code, the Act on the Provision of Electronic Services and other relevant provisions of Polish law shall apply.
  2. These Terms and Conditions do not exclude or limit any rights to which the Consumer is entitled under mandatory provisions of law. In the event of any conflict between the provisions of these Terms and Conditions and mandatory provisions of law granting rights to Consumers, the provisions of law shall take precedence. Any contractual provisions less favourable to the Consumer than those of the Consumer Rights Act are void, and the provisions of that Act shall apply in their place.
  3. Any disputes arising between MARPUR and a Customer who is not also a Consumer shall be referred to the court having jurisdiction over the registered office of the MAR-PUR Mariusz Kaczmarek shop, Świba 159, 63-600 Kępno
  4. The Terms and Conditions are available to Customers in electronic form on the shop’s website at www.marpur.pl (in the footer, under the ‘Terms and Conditions’ tab).

Dimensions may differ from the actual measurements by a tolerance of +/- 5 cm; this is due to the specific nature of upholstery products.
